TERMS OF SERVICE

Welcome to Act4Audio! These Terms of Service outline the rules and guidelines for using our sound and services. By engaging our services, you agree to these terms.

Services Provided

We nominally offer the following services:

  • Live sound reinforcement (PA) and audio mixing for bands, DJs, corporate events, and church events, and private parties.

  • Lighting for bands and mood lighting for parties.

  • Installed sound system (PA) design, tuning, and training.

  • Custom solutions such as audio recording, wireless systems, video capture, or streaming.

If agreed to in advance, we may be able to offer additional services such as:

  • DJ services, including music selection, performance as a DJ, or emcee services.

  • Event planning, coordination, or management.

  • Catering, venue decoration, or non-AV setup services.

  • Permanent installation of lighting systems or non-audio infrastructure.

  • Full-scale video production, editing, or post-production services beyond basic capture and streaming.

Services Not Provided

Act4Audio will generally not perform the following tasks on the day of the event due to liability concerns:

  • Electrical infrastructure setup or power distribution beyond connecting to client-provided power sources. Making electrical modifications, or unsafe power connections.

  • Modifying, repairing, or troubleshooting client-owned or third-party equipment.

  • Operating Act4Audio equipment beyond its designed specifications or in unsafe conditions.

  • Handling, moving, or managing non-Act4Audio equipment, props, or materials.

  • Performing unplanned physical installations or rigging of equipment.

  • Security services or crowd control including supervising, controlling, or managing event attendees or crowd behavior.

  • Providing unplanned AV services, such as additional equipment setups or streaming, not agreed upon in advance.

  • Engaging in hazardous activities, such as working in unsafe weather or environments.

Payment Terms

  • Payment is due upon completion of the service unless otherwise agreed.

  • We accept Venmo, Zelle, or PayPal.

  • For bookings over $500, a deposit of 25% of the total service cost is required.

  • Late payments may incur a fee of 5% per week.

Cancellation Policy

Cancellations must be made at least 24 hours before the scheduled call time to avoid a cancellation fee equal to the total deposit amount.

Liability

Act4Audio is not liable for any damage or injury resulting from the use of our services or equipment, except in cases of gross negligence or willful misconduct. For example, we are not responsible for:

  • Hearing damage caused by event attendees standing too close to speakers.

  • Injuries due to participants knocking over or falling over equipment.

  • Electrical system failure due to inadequate power supply or extreme weather if the client does not ensure proper conditions.

The client is responsible for providing a safe working environment for our staff and equipment, including adequate power, dry and level surfaces with sufficient structural support, protection from the elements, and protection from general mayhem caused by event participants or attendees.

Equipment Policy

If Act4Audio provides (rents) equipment without associated services, the client is responsible for its proper use and protection.

Any damage caused by misuse, accidents, or negligence, or actions of event participants or attendees will be the client’s responsibility.

Abuse and Harassment

Act4Audio maintains a zero-tolerance policy for abuse, harassment, or inappropriate behavior directed at its team members or subcontractors. Such behavior will result in immediate termination of the project without refund.

Intellectual Property

Act4Audio retains the right to retain a copy of any audio or video recordings for quality control and archival purposes. Any additional rights to the content will be agreed upon in writing.

Governing Law and Dispute Resolution

These Terms of Service are governed by the laws of the State of California. Any disputes arising will be handled through mediation or arbitration in California, in accordance with the rules of the American Arbitration Association.
